These Terms and Conditions ("Terms") govern your use of the dave3 platform and services ("Service"). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, please do not use the Service.
dave3 is operated in the United Kingdom. These Terms are governed by English law.
You must be at least 13 years of age to use this Service. If you are under 18, you confirm that you have obtained consent from a parent or guardian. By using the Service, you warrant that the information you provide is accurate and complete.
To access certain features, you must register for an account. You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account. You must notify us immediately of any unauthorised use at support@cleartext.com.
Some features of the Service require a paid subscription. Subscription fees are charged in advance on a recurring basis. All prices are inclusive of applicable VAT where required by UK law. You may cancel your subscription at any time; cancellation takes effect at the end of the current billing period.
We reserve the right to change subscription pricing with at least 30 days' notice to existing subscribers.
You retain ownership of any content you upload or post ("User Content"). By submitting User Content, you grant dave3 a non-exclusive, royalty-free, worldwide licence to host, display, and distribute your content solely for the purpose of operating the Service.
You are solely responsible for your User Content. You must not upload content that is unlawful, defamatory, obscene, infringing, or otherwise objectionable.
All intellectual property rights in the Service, including but not limited to software, design, logos, and text, are owned by or licensed to dave3. Nothing in these Terms grants you any right to use our intellectual property except as strictly necessary to use the Service.
You agree not to misuse the Service. Prohibited conduct includes but is not limited to: attempting to gain unauthorised access to the Service or its systems; transmitting malware or harmful code; scraping, harvesting, or systematically downloading content; impersonating any person or entity; and engaging in any activity that disrupts, degrades, or impairs the Service.
To the fullest extent permitted by law, dave3 shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service. Our total aggregate liability to you shall not exceed the amount paid by you to dave3 in the 12 months preceding the claim.
Nothing in these Terms limits liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be excluded under applicable UK law.
We reserve the right to suspend or terminate your account at our discretion if you breach these Terms, with or without notice. Upon termination, your right to use the Service ceases immediately. Provisions that by their nature should survive termination will do so.
These Terms are governed by and construed in accordance with the laws of England and Wales. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.
We may update these Terms from time to time. We will notify you of material changes by email or by a prominent notice on the Service. Your continued use of the Service after the changes take effect constitutes your acceptance of the new Terms.
